Manhattan prosecutors said Tuesday that they are not yet ready to try Cuba Gooding Jr.'s sex abuse case. The Jerry Maguire actor was set to begin that day.

Gooding appeared relaxed standing in Manhattan Criminal Court with his defense lawyer, Mark Heller. The 51-year-old star has been accused of forcible touching and sex abuse by a 29-year-old woman, who says he grabbed her breast at Manhattan's Magic Hour Rooftop Bar & Lounge in June. Gooding pleaded not guilty.

In June, Gooding surrendered to police for questioning, and was subsequently released. Later, surveillance video surfaced, and it appeared to show the Oscar-winner reaching over his girlfriend, Claudine De Niro, and his hand appeared near the woman's chest area and then he kissed her hand.

De Niro (the estranged wife of Robert De Niro's son Raphael) backs Gooding's account, as does Heller. In June, he told reporters: "There is not a scintilla of criminal culpability that can be attributed to Mr. Cuba Gooding Jr. after I have extensively, with my staff, reviewed the video of almost two hours which reflects the entire event."

The trial date was pushed to October 10th.
