More than 80 women have accused Harvey Weinstein of sexual misconduct, including rape, but one of the accusers' emails is not being used by his legal team in an attempt to have criminal charges against him dismissed.

Attorneys for the disgraced movie producer filed a motion for dismissal in New York federal court Friday, citing evidence they say the grand jury that indicted him never had access to.

Lawyers say the dozens of email sent from one of accusers are "warm, complimentary and solicitous messages" sent "immediately following" the alleged rape "and over the next four year period."

"These communications irrefutably reflect the true nature of this consensual intimate friendship, which never at any time included a forcible rape," Weinstein's attorney, Ben Brafman told CNN in a statement.

One note, sent on January 5, 2014, ten months after the alleged rape occurred, the unnamed accuser wrote: "Your (sic) the one who makes it look good with your smile and beautiful eyes!! But thank you that makes me so happy to hear."

In another sent July 10, 2014, she wrote: "There is no one else I would enjoy catching up with that understands me quite like you. I don't get off work usually till after 7 and coming from (redacted). I know I will be hungry, what is your timing? Do you have time for dinner?"

It is unclear whether there will be a hearing scheduled on the new motion. He is next due in court on September 20th.

MATT GROENING SHARES SELF-PORTRAIT: Ahead of his Matt Groening’s big debut on Netflix August 17th, the Simpsons creator shared a self-portrait of himself and discussed why he has "no internet presence whatsoever." He tells The Hollywood Reporter he’s simply "too sensitive" to deal with the backlash on social. Disenchantment is Groening’s first new series since Futurama dropped 20 years ago, and he says he’s psyched to be moving to the streaming service. "Netflix couldn't have been more supportive. They basically said 'yes' after a very quick pitch and have been completely supportive thereon — and that is unusual in the history of TV. There is usually a lot more worry and second-guessing as time goes on." He notes that Futurama never got love from Fox: "They so much didn't like it, they scheduled the show for 7 p.m. on Sunday nights and
then made the slogan of the network: 'The fun begins at 8 p.m.' So, I wasn't able to just read between the lines, I was able to read the line."

Oprah Winfrey dished about her favorite date night activities with Stedman Graham, and while they’re sexy, they’re also refreshingly … ordinary.

During an "Ask a Staffer" Q&A on The Oprah Magazine’s Instagram account, the media mogul fielded a lot of fun questions, from her dream destination (Antartica) to whether she’s hitting up Beyonce and Jay Z’s On the Run II tour ("Yes, honey!")

When asked how she keeps it hot with Graham, whom she’s been with for three decades, she said: "Well, I am a really good cook and the wonderful thing about Stedman is in all the years that I've been cooking for him, no matter what it is—even if it's a piece of toast like the other day I made an English muffin and he's like, 'Where did you get this English muffin?' and I'm like, 'It's an English muffin.'"

"He is delighted with anything that I make, so my favorite date night is to make him black-eyed peas and cornbread as a surprise for dinner and then honey, hush," she continued. "That's all you need!"

In other words, "Perfect date night: me cooking and then it's on."

Meghan Markle has not had an easy go of it. The newly minted Duchess has been in the spotlight for months now, especially leading up to and since her May 19th nuptials to Prince Harry and her 74-year-old father’s catastrophically revealing chats with the press (many of which he was allegedly paid for).

Now, it seems Meghan is being shielded from the media by the royal family in a desperate attempt to do damage control. Royal correspondent Richard Palmer claimed on Twitter that he and others are being kept away so they "can’t hear what she is saying. If you can’t get direct quotes from members of the Royal Family that often makes for dull stories. You go afterwards and ask what she said. Mr. Bloggs said: ‘The Duchess expressed the hope that women would eventually get the same opportunities as men in this profession.’ Boring."

A source described as a "good friend" says her relationship with her father Thomas is over, thanks to his increasingly embarrassing rants in the press about how the royal family is keeping her from him.

A source tells The Daily Mail: "A reconciliation is completely off the table at the moment. There's no chance right now—he's been a complete embarrassment."

"The Royal Family isn't as upset as you'd think," the friend continued. "Nothing any of them the Markle family say has any real consequence and they Meghan and Harry have more important things to focus on."

Accused sexual assaulter Harvey Weinstein claims he has 40 emails that that prove he didn't rape one of his more than 80 accusers, and he wants the criminal case against him dismissed. Last month, he was indicted on a criminal sexual assault charge that could land him, if convicted, in prison for life.

TMZ reports that Weinstein’s lawyers have filed docs claiming the accuser’s emails show hat they were consensual partners. Weinstein reportedly used a Weinstein Company email address during these exchanges. While his attorneys were able to access the records, a bankruptcy judge issued an order preventing him from disseminating them.

Weinstein’s legal team, headed by Benjamin Brafman, is now attempting to use the emails as an exhibit in a motion to dismiss the criminal indictment, claiming the Manhattan District Attorney was aware of the so-called evidence, but never provided them to the grand jury that indicted him on felony sexual assault charges. The emails reportedly only pertain to this particular indictment. A separate indictment against Weinstein involved two other women who claim he assaulted them. Weinstein has pleaded not guilty to all charges and has said since allegations broke in October of last year that he never engaged in nonconsensual sex. The team is expected to make the first bid to dismiss the criminal case in court today (Friday).

He is free on $1 million bail. Weinstein is being investigated by federal prosecutors, the Manhattan D.A., the NYPD, the LAPD, police in Beverly Hills and U.K. police.

Coates heard about the story and took to Twitter immediately to (understandably) humble-brag: "Incredibly honored & humbled @Jeopardy Alex Trebek 1) knows who I am 2) thinks I’d be a great host of my fave game show ever that I grew up watching w/ my family & still watch w/ my own kids (who saw him say this & now think I’m a genius) #Dying."

Zip it! Model, cookbook author, mom of two and Twitter maestro Chrissy Teigen said what we’ve all been thinking about Meghan Markle’s oh-so-chatty 74-year-old father.

"This guy...this guy sucks," Chrissy wrote in a tweet that also featured screenshots of recent interviews featuring Thomas. "What is wrong with him? Let your daughter be happy, please. This is embarrassing."

One highlight includes a classic poor-me quote: "Perhaps it would be easier if I were dead." Another features him saying that Harry’s late mother Princess Diana "would have loathed the way I've been treated."

This all comes on the heels of reports that Thomas faked needing heart surgery right before Meghan’s wedding to get out of attending after he humiliated her by staging paparazzi shots of himself looking wholesome and preparing for his visit to the U.K.

I want my daughter to see that and be like, 'Wow, my mother was a fully actualized, sensual woman." On life after Tatum, she said: "It's been a journey, and it's been a transformation of myself—my needs and wants as a woman. Comedian Sarah Silverman is the latest to be taken to task for a tweet she sent out several years ago. Conservative activists dug up her old tweet and are now labeling her a pedophile.

In July of 2009, Silvereman tweeted: "Hey, is it considered molestation if the child makes the first move? I'm gonna need a quick answer on this."

Townhall, a conservative publication, ran a story on the tweet with the headline: "Disney Voice Actress and Comedian Sarah Silverman Also Joked About Molesting Children."

Last year, Silverman was asked by a fan about the tweet, and she responded: "That's ok doll. Comedy is subjective. I thought it was a funny/dumb tweet 8 years ago when I posted it."

On Thursday, she posted about the controversy, tweeting: "Some very odd people R saying I'm a pedo, re: a joke from a time not that long ago when hard absurd jokes by comedians were acknowledged for what they were -- jokes -- not a disengenuous national threat to people fake-clutching their pearls (whilst ranting the country's too PC)."

Ansel Elgort recently signed on as Global Ambassador for Ralph Lauren Polo Red’s fragrance franchise, and the Fault in Our Stars actor seems ideally suited for the role.

He tells Refinery 29 that he often raids his girlfriend Violetta Komyshan's stash of beauty products: "I'll use her stuff. We just share everything."

And by everything he means, just that. The Baby Driver star tells People: "We share handbags — I wear handbags now. Purses are really cool, or like the ones you put over your shoulder. You can put your camera in there, your phone, your wallet. Sometimes if I’m wearing tight pants I don’t want to put anything in my pocket. Or sometimes it falls out of my pocket. So we share those now."

Regarding his favorite scent (he is the face of a fragrance after all), the 24-year-old says: "I really love home-cooked meals, the smell of food in the oven."

A white man stabbed two young black women, one of them to death, in Oakland on Sunday night. Nia Wilson, 18, died as her sister, Lahtifa, 26, tried to protect her. The suspect was arrested Tuesday. The violence has been interpreted as racist in nature, and activists and celebrities have flooded social media with their outrage.

Anne Hathaway joined them Wednesday night with a powerful post that called on white people, including herself, to reflect on their privilege.

"The murder of Nia Wilson—may she rest in the power and peace she was denied here—is unspeakable AND MUST NOT be met with silence," Hathaway wrote. "She is not a hashtag; she was a black woman and she was murdered in cold blood by a white man."

She continued, writing that "all black people fear for their lives DAILY...and have done so for GENERATIONS." She added, "White people DO NOT have equivalence for this fear of violence."

"Given those givens, we must ask our (white)selves—how 'decent' are we really?," she continued. "Not in our intent, but in our actions? In our lack of action?"

JAMES CAMERON BACKS BID FOR THOUSANDS OF TITANIC ITEMS: James Cameron is helping to back a bid by a group of British museums who seek to acquire a collection of 5,500 artifacts from the sunken Titanic ship. The group aims to raise $20 million to buy the items salvaged by an American company. Cameron, who directed the epic 1997 film Titanic, starring Leonardo DiCaprio and Kate Winslet, noted his concerns about the collection. "That's why people who feel some protective role have stepped up and kind of linked arms," Cameron said in a statement. "It's an incredible piece of history, an object lesson about human hubris. If it gets sold into private hands, it disappears from the public eye. It would be broken up and could never be reassembled." Items include a section of the ship's hull and a bronze cherub decoration from the ship's grand staircase.

BILL SIMMONS INKS NEW DEAL WITH HBO: After finding his groove with Andre the Giant (the most-watched documentary in HBO Sports history with 7 million viewers), Bill Simmons is extending his deal with HBO. He is set to create and produce sports-themed content across HBO’s portfolio. In a statement, he said: "I’m thrilled to keep going with the HBO family and can’t wait to get started on a couple of the more ambitious projects we’ve hatched. I witnessed it firsthand with our Andre doc — when you create something unique for HBO, they’ve built so much trust and equity in their audience over the years that it’s always going to be seen. Every single time. If it’s good and it’s on HBO, it will stand out. Even though we have more entertainment choices than ever right now, HBO still cuts through in an incredibly precise, almost unassailable way — and they work better with creatives than anyone, period. I am lucky to work with them and I know it."

Teen Mom 2 star Jenelle Evans pulled out a gun during a road rage incident on Monday’s episode of the MTV hit, and fans are outraged.

Her 8-year-old son Jace was in the car as Evans, a mother of three, became increasingly enraged as a truck tailgated her.

During the incident, Evans slammed on her brakes, yelling, "Are you f---ing kidding me, dude? Oh my God." Evans then proceeded to follow the driver home, while relating the incident to her husband David Eason on the phone.

"Now I’m in front of his house," she told her husband as she continued to yell at the driver. "'I got three cameras in my car; they got the whole thing I just called the law on you, you were tailgating me, you dumba--.'"

When she finally decided to leave his house, she hit his mailbox with her car and the other driver tried to block her from leaving, at which point she pulled out her gun. (MTV did not show the footage, and instead wrote in white text on a black screen that she pulled out her firearm).

When she did get back on the road, police pulled her over. No one has been charged in the incident.

Interestingly, some fans seemed just as angry that Jace was riding in the front seat as they were that she got a gun.

A user wrote, "Seriously Jenelle? Why on earth does Jace ride in the front seat of your car?? Don’t you know the AMA recommends kids ride in the backseat until at least age 12?"

Other fans begged MTV to intervene and take her kids from her.
